After more than a 6 month wait, starting on June 16th, 29 people, both men and women, who were arbitrarily detained on the 25 of November 2006, initiated a process of denunciations against members of the public security of the State Government of Oaxaca and the Federal Government, responsible for torture crimes, cruel acts, sexual abuse, illegal deprivation of freedom and other human rights violations.

Within the framework of the Universal Periodic Review (UPR) carried out by the Human Rights Council of the UN, with regards to Mexico, state and national organizations of civil society have completed in-depth work to express their concern regarding the issue of human rights. As part of this joint work, the Liberation Committee 25 of November continues to denounce the serious and ongoing human rights violations in Oaxaca.

La Lic. Alba Cruz Ramos, encargada del Área Jurídica del Comité 25 de Noviembre, ha presentado el lunes 27 de abrio una denuncia penal por amenazas e intimidación con el número de averiguación previa PGR/OAX/OAX/II/230/2009. Lo anterior relacionado a su trabajo como defensora de derechos humanos y abogada varios procesos que involucran a presos políticos y asesinatos políticos en el estado de Oaxaca.

La SCJN determino en agosto de 2007, de acuerdo a su facultad de investigación, realizar una investigación sobre las Violaciones Graves a las Garantías Individuales en relación al Caso de Oaxaca para ello, determinó como periodo de investigación el siguiente: mayo de 2006 al 31 de enero de 2007, 16 y 17 de julio de 2007.

La Comisión de Investigación fue establecida en agosto de 2007 y mantiene funciones a la fecha, cabe señalar que durante este tiempo ha tenido dos ampliaciones a su periodo de investigación. Esta Comisión ha sido la encargada de: Solicitar documentación, la colaboración de personas físicas y morales, revisar documentos en oficinas publicas, solicitar apoyo técnico de especialistas, realizando con estos documentos, una relación de elementos de convicción, observaciones y análisis de constancias y emitió las conclusiones que resultan ser el Informe Preliminar que hoy fue presentado ante el pleno de la Corte.
