The Supreme Court determined in August 2007 to undertake an investigation about Serious Violations to Individual Rights related to the Case of Oaxaca. The investigation was to cover the dates May 2006 to January 31 2007, and the 16 and 17 of July 2007.

The Investigation Commission was established in August 2007 and continues to the present date. This Commission has been responsible for: Requesting documentation, investigating the involvement of individuals or legal entities, reviewing documents in public offices, asking for the technical support of specialists, and from these documents establishing the relationship of the elements of conviction, analyzing the evidence and presenting the conclusions. Those conclusions were presented today before the entire court in the Preliminary Report.

COMUNICADO, 20 de marzo de 2009

• El gobierno federal con el pretexto de combate a la delincuencia organizada y narcotráfico esta violentando los derechos humanos y garantías individuales de los ciudadanos Oaxaqueños.
• El incremento de la fuerza Militares en la ciudad de Oaxaca, ponen un alto grado de tensión a la sociedad Oaxaqueña ante casos concretos de violaciones a derechos humanos.

El día de ayer se realizo una diligencia, donde comparecieron elementos de la Agencia Federal de Investigaciones para incriminar a Juan Manuel, siguiendo la hipótesis de la PGR, esto demuestra la parcialidad de las instituciones de justicia encargadas del caso.

En el mes de junio de 2007, a través de  la Cámara de Diputados Federal, se aprobó la iniciativa para solicitar la investigación de la Suprema Corte de Justicia de la Nación (SCJN) en el Caso Oaxaca. La SCJN tiene la facultad de investigar «Violaciones graves a las garantías individuales», se trata de un procedimiento poco usado, hasta la fecha hay tres antecedentes: Aguas Blancas, Lydia Cacho y Atenco.
