• With the pretext of combating organized crime and drug trafficking, the federal government is violating the human rights and individual liberties of Oaxacan citizens.
• The increase of military force in the city of Oaxaca puts a high level of tension on a Oaxacan society facing concrete cases of human rights violations.

TO THE GENERAL PUBLIC,

To the National and International Human Rights Organizations,

Our country is confronting a gradual militarization behind the argument of combating drug trafficking and organized crime.  In the realm of human rights this has meant grave violations, purporting a standard of impunity and ignoring constitutional guarantees.  As such, in the two years of the current government, 15 documented recommendations have been made to the National Defense Secretary by the National Commission of Human Rights, as well as other reports by civil organizations that have recorded various aggressions.

Oaxaca is no exception.  In recent months, Mexican military patrols and posts on the state highways have been constant, carrying out illegal interrogations on motorists and passengers, permitting their passing after aggressive anti-constitutional inspections.  Additionally, we have been able to affirm that since 2006, the military has intensified their operations in different regions of the state through: more posts on the highway, breaches into different communities, installation of military camps, and penetrating the communities in order to plant fear in the people.

The patrols have been constant; it’s in this manner that the violations towards human rights and individual liberties comply with the policy of criminalizing every person that has the bad luck of crossing paths with military operatives.  Just in the last month, four cases of torture have been made public, three of them in the Isthmo de Tehuantepec (the storekeeper Guillermo Marín Campos on the 28^th of February in Salina Cruz, Rodolfo Xicoténcatl González and Ernesto Quiroz Fernández on the 22^nd of February).

The fourth case is of Roman Garcia Hernandez, a rural worker originally of the San Dionisio Ocotepec, Tlacolula Oaxaca, who was brutally detained at a military post and accused of transporting drugs.  He was sent this past 6^th of March to the public hospital in a state of comatose, and although he has responded to treatment, he remains in a delicate state of health and the potential cerebral damages remain unknown.

«Siendo aproximadamente las 17:30 del día viernes 27 febrero salimos yo y mi esposo de nuestro domicilio, ubicado en la población de San Dionisio Ocotepec, Tlacolula Oaxaca,  caminamos sobre la carretera nos dirigíamos hacia el Rancho las Lagunas, pedimos un aventón y se paro una camioneta, solo venia un conductor, nos dijo que nos subiéramos en la batea de la camioneta, nos subimos solo vimos que venían unas cajas de cartón. Transcurrieron unos veinte minutos de camino, eran aproximadamente las 6:30 de la tarde, ya habíamos avanzado como dos kilómetros de San Dionisio, rumbo al rancho las lagunas, sorpresivamente el conductor de la camioneta se paró y se bajó de la camioneta empezando a correr hacia el campo, porque adelante habia un reten militar. Eran cinco personas las que se acercan a la camioneta traían armas largas, nos encañonaron  y se dirigen hacia nosotros, nos insultaban decían «bájense de la pinche camioneta putos, ya se los cargo la chingada». Como no sabíamos que hacer uno de los militares se sube a la camioneta y bota a mi esposo sobre el piso desde arriba de la camioneta, cuando el cae empieza a sangrar de su cabeza, yo me asuste mucho pero no me permitían explicar nada, ellos solo nos decían insultos, eran tres los que golpeaban a mi esposo por que los otros dos solo observaban.

Ya tirado en el piso le empezaron a golpear con las culatas de sus armas largas en el estomago, con fuerza y saña, mientras nos mentaban la madre, y nos decían muchas groserías, hay cosas que no entendía por que no entiendo bien el castellano, ya que nuestra lengua es el zapoteco. Empezaron a preguntar de quien era lo que había en la camioneta, y sin dejarlo de golpear insistían en que dijera de quien era la camioneta, pero mi esposo y yo no lo sabemos. Como no decíamos lo que ellos querían, siguieron golpeándolo llevándolo sobre el camino de terracería a rastras hasta llegar a un estanque en donde habitualmente toman agua los animales (bebedero de agua para ganado) de aproximadamente un metro de profundidad, ahí agarraron de la cabeza a mi esposo y lo sumergieron en el agua tratando de ahogarlo. Yo les suplicaba que lo dejaran pero no hacían caso, pude darme cuenta que uno de los que lo golpeaban es el Subteniente Alfredo Hernández Méndez de infantería y batallón, por que eso llevaba bordado en su uniforme. Tambien pude ver los nombres de otras dos personas TEODARDO OSORIO JIMENEZ Y CARLOS VASQUEZ GARCIA.

Mi esposo casi se ahogaba cuando lo dejaron de sumergir, ya no podía hablar ni moverse, sangraba de su cabeza, como no podíamos decirles de quien era la camioneta. Yo me asuste mucho y empecé a correr hacia mi domicilio, desesperada pensé que mi esposo lo podían haber matado, cuando llegue a mi domicilio le conté lo que había pasado a mi familia, ya no pudimos salir de la población por que ya era muy noche, al otro día temprano, es decir, el día 28 de febrero me dirigí acompañada de un familiar a la Procuraduría General de la República, lugar en donde me dijeron que si lo habían llevado en calidad de detenido, pero que debido a la certificación medica y al estar delicado de salud, lo habían canalizado al Hospital Civil para que recibiera atención médica. Lugar a donde me traslade inmediatamente y se me informo que mi esposo se encuentra muy grave, que presenta un cuadro de Insuficiencia respiratoria aguada de adulto SIRPA, tambien me fue informado que tiene una guardia permanente por parte de la PGR. El se encuentra inconsciente y por lo tanto no es posible aun que diga lo que le paso.»

On behalf of all of the above:

1. WE REJECT energetically the intervention of military force in actions of public security being carried out in the state.
2. WE MAKE RESPONSIBLE the federal government for the violent acts experienced by Mr. Roman Garcia at the hands of members of the MEXICAN MILITARY, who have put his life in danger.
3. WE DEMAND of the National Defense Secretary strict respect of the human rights and individual liberties of every citizen.
4. WE DEMAND of the federal government immediate attention to this awful occurrence, which was carried out by members of the MEXICAN MILITARY;  consequently we urge the immediate withdrawal of the Mexican military from the state of Oaxaca and the guarantee of full granting of citizen’s rights.
5. WE SOLICIT the National Commission of Human Rights to act with impartiality and promptness, putting into place the recommendations regarding the human rights violations committed against ROMAN GARCIA HERNANDEZ.
